Michigan medical malpractice attorney Thomas L. Stroble says parents of disabled children should seek legal help if government budget cuts affect their access to assistance previously covered by Medicaid.
As members of Congress and President Barack Obama weighed cuts in Medicaid in ongoing negotiations about the nation’s debt ceiling and budget in recent weeks, the Health Policy Institute at Georgetown University reported that about 2.9 million children with autism, cancer and other special health care needs rely on Medicaid or the Children's Health Insurance Program as their primary source of health care coverage. Many others rely on government programs for part of their coverage, the study says.
“Unfortunately, as substantial federal budget cuts become more likely, it’s programs that take care of people, like Medicaid, that are likely to be targeted first,” said Stroble, whose Michigan medical malpractice law firm, Michigan Injury Lawyers, P.C., represents clients across Michigan from offices in Oakland and Macomb counties. “But those who rely on these programs need to consider other options, particularly parents of children afflicted with medical problems since birth.”
Stroble explained that if medical malpractice or hospital negligence played a role in a child’s birth injuries, that child’s parents or caretakers should seek help to determine whether they are due assistance with long-term care.
“Many birth injuries are so-called ‘acts of God,’ but many others are caused by demonstrable mistakes or negligence on the part of doctors, nurses or technicians, or even the policies or protocols of the hospital itself,” Stroble said. “When this is the case, that child’s parents are due compensation for what will be a lifetime of medical bills.”
